Intercultural mediation

Increasing number of mixed marriages effected by EU citizens with the citizens of the CIS countries highlighted a need for legal regulation of marriage and family relations and child-rearing issues both at a national and at local (interfamily) level. Given that the legal systems in different countries are not the same, advising of a lawyer specializing in international private (incl.family) law has become necessary today. Divorce of the spouses and the subsequent decision on the manner of communication with the child nowadays are not made without the numerous and sometimes painful contacts with the governmental authorities. The Russian-Austrian Center for Mediation and Law advises citizens on civil and family law and accompanies the applying clients at all stages of communication with all governmental agencies, including the Department for Youth affairs in Austria and guardianship authorities in Russia. We accompany our clients in the courts of Austria and Russia and offer a young but positively proven by judiciary and other law enforcement authorities method of solving family conflicts through mediation. Calling mediation "small judicial council", our experts observe strong interest in this procedure from various social strata.

It has been noticed that the couple, choked with emotions, cannot come to an agreement with each other on the matters of children's education and adequate distribution of joint property on their own. Neglecting the interests of the partner impedes the constructive resolution of the dispute and burns the bridges to safe normal respectful relations.

The participation of a third party as an independent arbitrator in settlement of the conflict helps the spouses to keep their emotions at bay and make the balanced decisions that can meet the interests of both. The Russian-Austrian Center for Mediation renders assistance to the families and former spouses in settling all existing disagreements and conflicts. We use scientifically developed and tested methods of crisis management and fix the victories achieved by the parties in overcoming the conflict using the legally competent language.

We prepare for the parties the settlement agreement, which in accordance with the legislation is to be approved by the court and is binding. In case of failure to reach an agreement by the parties, the lawyers of the Center are ready to assist and facilitate in referring the claim to the court, helping to correctly formulate the stated claims and effectively collect the necessary evidence and expert opinions. We also provide assistance in defending the interests of the defendants applying to us with family disputes, seeking to fix the maximum scope of their rights to communicate with the child in the final judicial documents. At the request of applicants, we track the progress of the case at all stages and help to bring the dispute to its final logical solution. We keep confidentiality and guarantee the non-disclosure of the information about customers, their problems and requests received in connection with our business.
