Family mediation

Sad, but true - the relations between spouses are not always built on mutual understanding, and the differences, unfortunately, are not always settled by consensus. Failure to reach coherence provokes spouses to break relations, emerging conflict will evoke various courts visits within a long period.

The family mediation prevails where constructive dialogue is impossible without outside interference. The family mediator negotiates between spouses and other family members, helping the latter to understand each other, find a compromise and, as appropriate, maintain family relations or peacefully resolve the psychological or legal problems, including those related to property, support and education of children. He/she may also help to restore the relations after divorce which is especially important in case of common children.

The family mediator, as a professional, can provide the services related to the preparation and drafting of the marriage contract, as well as its amendment and termination; legal expertise of the marriage contract prepared by the parties; preparation and drafting of an agreement on division of spouses' common property; legal assistance in addressing the issues in the field of enforcement of maintenance obligations that arise between parents and children, spouses and former spouses, and other family members, in particular, brothers and sisters; grandparents and grandchildren; foster children and actual fosterers; drafting an agreement on alimony payment; resolution of disputes between spouses in the field of housing relations; legal assistance in solving other issues in the field of family relations in order to prevent possible disputes in the future.

Experience has shown that there is a negligible amount of the agreements on alimony payments which mostly are not oncluded due to ignorance of legal provisions and lack of understanding of all the nuances. If the spouses are unable to reach a compromise with respect to the size of the maintenance, they can choose one or more mediators to conclude a mediation agreement. The mediator must be particularly unconcerned as to the outcome of the case. During the entire mediation procedure the mediator may meet and communicate with the spouses together and with each of them separately. In the course of the mediation procedure, the mediator may not put either of the parties in a privileged position, as well as diminish the rights and legitimate interests of either of the parties.
